The Umstead Coalition has appealed DEQ's approval for Wake Stone to destroy riparian Neuse River buffers along Crabtree Creek for their new bridge to access their proposed new quarry pit on the Odd Fellows Tract. We have our first court date on October 11 where DEQ has filed a motion to throw our case out. We expect the first part of the Hearing to be on their "Motion to Dismiss" and for our attorney's to content we have solid grounds to proceed to a contested Trial to allow our expert engineers to testify. Then, we hope to proceed to the contested trial.
Attendance in the audience is helpful to show public support for our cause. Ideally, we'd have 5 to 10 folks in the audience. Please come if you can attend. Arrive at 8:30am to show ID, sign-in and go through a security check to be ready for a 9am start. Sit in the section behind the Umstead Coalition attorneys. The trials might last through Tuesday, but even if you can show for the morning of October 11, that would be helpful.
More info: This is an Appeal we previously won (with a different judge) at OAH because alternatives to avoid and minimize impacts to the riparian buffers along Crabtree Creek with the proposed bridge connecting RDU Quarry and the existing Triangle Quarry on the other side were not pursued as the law requires. Wake Stone submitted a new Application with the SAME bridge location and design. DEQ again issued the Buffer Authorization (to destroy riparian buffers) and we appealed (again). October 11 Hearing will be an attempt for DEQ to contend we do not have a case and for The Umstead Coalition to contend we have solid ground for our Appeal and we request a full contested Trial so our Expert Engineering Experts can testify and we can fully present our case.
