Hearing on the Umstead Coalition's Request to Proceed to Trial on Merits-Sunset Clause and Buffers

The Sunset Clause to end the Triangle Quarry operations on Harrison Avenue by the Reedy Creek Park entrance by 2031— promised to Umstead State Park and the public and agreed to by Wake Stone Corporation in 1981 and subsequently in 8 Mining Permit Renewals and Modifications for 37 years — needs to be reinstated.
The next court action in the Umstead Coalition's fight to restore the Sunset Clause and reinstate the protective forested buffers is 10am Thursday, December11. We now have two related cases that have evolved - the lawsuit we filed at Wake County Superior Court in July 2022 and our Appeal of the case failing to be heard at the Office of Administrative Hearings (OAH).
The December 11 court session is a hearing before a Wake County Superior Court judge on or July 2022 court filing - it's supposed to be just a short "status hearing."
It is always good to have our supporters in the audience; it's likely to be a small court room so 5 to 10 attendees is ideal. Here's what to expect if you attend. Arrive at the courthouse by 9:45am, go through security and take the elevator to the 10th floor, Court Room 10C. You can come and go from the court room, but can't talk while court is in session.
First, the judge will run through the all the cases scheduled and then determine when our case will be heard.
