Logistics: 

 Arrive by 9:45am to show ID, sign-in and go through a  security check to be ready for a 10am start.  Sit in the section behind the Umstead Coalition attorneys (on the right).

What:

Finally (after numerous delays by Wake Stone), the Umstead Coalition finally was scheduled for a Trial appealing Wake Stone's 2023 Mining Permit (that the State was forced to issue per the same judge we are before this week).  Then, the judge let Wake Stone Intervene (same judge that would not allow the Umstead Coalition to Intervene in the Appeal of DEQ's permit denial).  Then, of all absurdity, Wake Stone filed a motion to eliminate the Umstead Coalition from the case (rationale - the State did a great job when reviewing the mining application, the Umstead Coalition has no claims left) -- this is against all laws and precedent.  Yet, the same judge granted this motion.  

What remains for THIS week's trial is the Appeal by the adjacent private resident.  That case is very strong and the same lawyers defending the residence as the same as defend the Umstead Coalition.   

The judge refused to reschedule trial based upon Wake Stone failing to comply with Discovery and being tardy on what they did provide.  Then, on Saturday morning informed all parties that he would only allow 2 days this week for the trial (despite expert witness are traveling in from various states and it is expensive to make them travel for a continued trial next week).  

The Umstead Coalition will appeal to Wake County Superior Court to be re-instated as a  party in the case and for a full trial on all the merits be heard.  

THIS WEEK will be the trial regarding damage to the private residence.  There are excellent experts that will support the valid claims of the private land owners.  

Public is welcome and we would LOVE supporters in the courtroom.
